Judge Martin Smith Allows David Perry to Travel to Hawaii to Visit Latest “Soul-Mate”

While David Perry’s first “soul-mate” Kelly Rothwell remains missing and presumed dead, her abusive ex-boyfriend David Perry has moved on … to a NEW “soul-mate”, Melissa Walker, an Army  Medical Specialist stationed in Honolulu, Hawaii. Although warned by police of Perry’s prior domestic abuse and current charges of New York Workman’s Comp fraud, Ms. Walker will apparently be welcoming her new beau for almost a month. Perry was granted leave by Judge Martin Smith of Broome County to leave the state of New York, where he is currently being charged with Felony Grand Larceny, charged with faking an injury to receive Work Comp benefits. It seems that Ms. Walker doesn't feel overly concerned about the fact that Perry’s girlfriend in Florida, Kelly Rothwell, is missing and that Perry has been named a suspect in her “disappearance.” She has been warned by police about his possible complicity in Rothwell’s disappearance and his continued lack of cooperation with authorities in Florida. Doesn't she see the pattern of documented abuse he has been perpetrating his whole life? Perry’s own mother didn't even want him at her funeral.

It seems Perry likes to find strong, successful women…. And then he crushes them, with over-possessiveness, paranoia, physical and emotional abuse and intense jealousy. One wonders how he’ll feel with his new girlfriend being around so many Army soldiers… MALE Army soldiers.

I suppose Judge Smith thinks that the fraud charges are of such minimal scope that Perry can be trusted to return from his little surfing safari to face charges if and when a Grand Jury is called to indict him for Felony Grand Larceny and Fraud. But why hasn’t the Government and the Social Security Administration, whose benefits Perry ALSO allegedly fraudulently received brought their Federal charges against him as well? Could it just be that the wheels of justice are turning slowly, per usual? Could it be that they have already filed that paperwork so that Perry would be charged with additional crimes? Social Security would have a strong case if it is determined that he allegedly bilked them for thousands for dollars as well.

There have been rumors of safe deposit boxes in Chemung Canal Bank in Elmira that contain thousands of stashed dollars ; perhaps THIS is how Perry will pay for his month in Hawaii? Doesn’t anyone else wonder how he is paying for all of this? WHERE is the money coming from? A suitcase? Loans from friends? The State of New York Insurance Fund? And WHY would a judge  let him leave the State of New York when he is ALSO a suspect in a young woman’s “disappearance”? I suppose the good judge thinks one is not connected to the other. But he could be wrong… dead wrong.

It is said that David Perry had a plan back in October of 2003, to get out of working for a living. He heard a radio call, about an inmate fight on I Block, a location that was all the way on the far side of the jail, opposite of where Perry, a chart worker, was stationed. Witnesses said that when Perry heard the call, he jumped up, told his superior that he was leaving and that he wasn’t coming back. In order for Perry to even get to the area where the fight broke out, he was required to come off the Cage Floor gate, which was locked and had to be opened by another C.O., through F Block, then H Block then another locked door, where another C.O. had to let him through.  He would then have had to go up a flight of stairs, then proceed to I Block, and go past at least 30-35 cells to even GET to the fight.

Witnesses who were in the cell with the two inmates, (one was a porter, an inmate, who served food and cleaned up the galleys, as the rows of cells are called) said that Perry never even made it to the fight. Perry claims that he was injured when he tackled an inmate and then fell back onto the inmate’s bed, hurting his back. In that approximately 8x10 ft cell were THREE large C.O.’s and TWO inmates, who were subdued quickly.  Also in a statement by Perry’s Chart Sergeant, he was ordered NOT to go, with the Sgt. telling him to get back to his post. Another C.O. also heard Perry say that he wouldn’t be back.

So with all of this evidence, including witnesses who directly refute Perry’s claim of the chain of events surrounding his injury, WHY would Judge Smith let Perry leave New York, especially with not one but TWO Felony counts of fraud leveled against him? And WHY hasn't Sandra Cardone, the Broome County A.D.A. convened a Grand Jury yet?

The police in Florida better get moving and make a case soon for Kelly Rothwell… otherwise someone will be surfing it up,  “bad back” and all...

The Torment Continues for the Rothwell Family as Perry Supporters Taunt and Jeer Them On Facebook

The family of  missing Police Cadet Kelly Rothwell has been waiting for almost 4 months for any sign of Kelly Rothwell, following her disappearance March 12th of this year. David Perry, Kelly's then live-in boyfriend fled to New York sometime shortly after she was to tell him she was breaking up with him. He has consistently refuse to speak or help in any way in the search for Kelly. Now, 4 months later he has been named a suspect in her disappearance.


 Concurrently he is charged with  Insurance Fraud and Felony Grand Larceny by the state of New York, for filing a fake injury claim after an alleged back injury stemming from a fight at the Elmira prison where he was employed at the time. He has also been collecting Social Security benefits for his injury as well. . His NY insurance fraud and grand larceny charges are separate from the  federal government charges that could be filed, if his claim of injury is found to be false. Congress and  the SSA have collaborated to make fraud against the Title II programs( programs of paid  benefits to injured persons) punishable as a felony, resulting in penalties of imprisonment up to five years and a fine of as much as $250,000. ( according to the SSA website)  
After a five day stint in the Broome County jail, Perry has now  been living in his 1780 W.Church St. house in Elmira, New York, with his daughter and her children. He has been seen mowing the lawn and biking along local streets, often stopping  in mornings at a local gas station/convenience store. He was also seen unloading a red kayak from the top of a dark gray truck.  All this from a man with an injured back.
 A normal kayak, can weigh anywhere from 34 to 50 lb.


The case of missing Kelly Rothwell has garnered international attention; the Associated Press, the London Daily Mail, and several hundred newspapers and online media outlets have all been covering the story. Kelly's case was featured on CNN's Nancy Grace several times and other respected true-life television documentary shows are also very interested.


The Rothwell family has offered a $25,000.00 reward to anyone with knowledge of Kelly's whereabouts and for her safe return to her family. They all feel that Kelly is dead and have no illusions of bringing her home alive. They all firmly believe as do a multitude of people, that David Perry killed her in their Indian Rocks Beach condo and disposed of her body , then fled to New York. He has remained silent and uncooperative. He and his relatives and "supporters" have been taunting the family through the social network, Facebook, creating a page that was peppered with insults and attacks on Kelly's character and that of her family and friends. Those same people posted such vile and disgusting remarks on a story written in an online publication, words so crass and remarks so disparaging that the writer of the piece removed them. This is the man who told people Kelly was his "soul mate".. This is the man that never helped with the search for her when she went "missing" .. this is the man who already has a girlfriend, supposedly just two weeks after Kelly "disappeared". This is also the man that cancelled his gym membership, two weeks before Kelly went missing, telling his friends that "he and his girlfriend were moving to Hawaii." He never SAID it was Kelly that was going with him... And now that NEW girlfriend , Melissa Walker, a Specialist in the army and stationed IN HAWAII, is patiently and naively waiting for a man who cares SO little for the woman that he "loved" before her, that he can't find the time to help look for her.  
Melissa Walker has been warned by police about David Perry's documented incidents of domestic violence. In a letter posted in Facebook, his own brother Patrick apologizes for his brother's "possible" actions, calling him pompous, arrogant and a conceded (sic) ass. How can a family who knows this man's propensity for violence continue to defend him and at the same time taunt the family on a Facebook page declaring his innocence  without any way to clarify?


Time will tell and Kelly Rothwell WILL be found. Meanwhile the slow wheels of justice are turning on Perry's fraud case. The case has several witnesses and appears to be a strong one against him. 
 Something tells me that he better not pack his surfboard just yet....

Broome County D.A. Office Update about David Perry Fraud Case

Just in:

According to Broome County ADA Sandra Cardone, the Assistant District Attorney assigned to handle the Perry Insurance Fraud case, she has just recently sent the reports of the case to Perry's Broome County Attorney John Scanlon and is awaiting his response.

 Often, cases like these can go to a negotiated settlement; if not, then a Grand Jury will be convened to hear the felony charges and determine if there is enough evidence to indict Perry for Insurance Fraud and Grand Larceny.

 As of today, there has been no response from Perry's attorney.

Close Friend of Kelly Rothwell's Recounts David Perry's Bizarre Behavior

Catherine Pranskatis knew Kelly when she lived in Colorado and when Kelly moved they swore to keep in touch. When she went to visit Kelly in Indian Rocks Beach for a week, she got to see first hand what Kelly was dealing with in her home life. And what she saw disturbed her... greatly.

"Kelly and I used to talk all the time; we were both into meditative issues and mental healing, " Catherine
said."

"From the minute I got there, I could tell that Dave didn't want me there; he would grow really impatient when Kelly and I would sit and talk for hours. He didn't want us to talk; he would make noise or slam doors or kitchen drawers, just be really disruptive. It drove me nuts and I could see what Kelly was dealing with. She would try to soothe him and calm him down, but I could tell two days into my week-long stay that he wanted me gone."

Catherine said Dave vacuumed 4-5 times a day, even going into the guest room she was staying in.

"He went into the room I was staying in and moved all my stuff, so he could vacuum the floor in there. It was just bizarre. He picked my stuff up and sort of threw it out of the way."

Catherine sat with Kelly and asked her what was up.

Kelly told her that he liked to 'see the lines in the carpet.'
"I looked at Kelly and said THAT is NOT normal; this guy sounds like he has mental issues!"

Catherine told me that Kelly actually moved to West Virginia, to take a job and break up with Dave. She figured if she left Florida, she could start a new life with a new job. But Dave followed her, staying in the hotel where she worked with her, berating her the whole time about moving back to Florida. He didn't want to let go of the condo; he said he liked being so close to the beach. He was unhappy in West Virginia and told her every chance he could.

Ultimately, to pacify him, Kelly came back to Florida, giving up her hotel job in West Virginia.

"Kelly only talked to me once about Dave's behavior," Catherine said. "She told me that he was very loud and abusive and that she thought he would hit her. I said 'you have to leave him, he's just not right mentally'...
She never spoke to me about him again."

Relief, Anxiety Grow as David Perry is Formally Named a Suspect in Kelly Rothwell's Disappearance

Candles in the sand light the beach as the third month of Kelly's going missing passes by.

Today's announcement by the Pinellas County Sheriff's Department  formally naming David Perry a suspect in the disappearance of Kelly Rothwell was greeted with sighs of relief and speculation. The announcement could not have come at a better time; family and friends of Kelly have been speculating about the case's status for weeks. But Detective Mike Bailey, the lead on this case, and coincidentally the same detective who broke a 20 year old cold case wide open and solved it on this day as well, can feel a sense  of accomplishment and progress, however small it might appear to be to the public.

The very naming of Perry as a suspect will put him in a bigger spotlight, one he seems to like to be in. He has constantly taunted the family and friends of Kelly on a Facebook page that claims his innocence, while quoting such a bizarre range of notables as Buddha, Green Day, Cat Stevens, Transcendental Meditation and praising his attorney Tom Reilly's statement to the press to "suck a rock" in an effort to try and convince the three  official readers who"liked "the page of the depth of his soul.

More interesting STILL is the news today that Perry QUIT his gym membership , announcing he was moving to Hawaii with his girlfriend, BEFORE Kelly Rothwell went missing. Further, it seems that his NEW girlfriend, Melissa Walker HAS moved to Hawaii , no doubt awaiting her "soul mate" and true love, David Perry. This speaks volumes in that it seems Perry knew BEFORE Kelly went missing that he was "moving" to Hawaii... how do it know???? Can that be an important clue as to his state of mind regarding Kelly  PRIOR to her disappearance? The things that make you go hhhmmm sometimes.... really?

The news today was a long time coming for Kelly's family, especially her mother, Nancy Rothwell. I know Nancy and respect her need for privacy , away from the glare of the media lights and cameras. She is a kind and gentle woman who has lost her daughter and while the public may not hear from her often, she is non-the-less fighting for her daughter's justice  behind the scenes. Today's news for her was good and evoked a sense of cautious optimism. She is always very careful with her words...

"I feel that today is a definite step closer to finding justice for Kelly," she told me earlier this afternoon."  Now he (David) needs to come forward and own up to what he's done. It seems to me that when he does, he  will eventually feel better. His true colors are going to show."

Listening to Nancy, it's easy to see where Kelly gets her sense of fair play and even temperament.Even in her grief, Nancy Rothwell feels that David Perry will  do the right thing, admit that he harmed her daughter, and own up to it, accepting the consequences of his actions. However, it doesn't mean that Nancy doesn't believe in judgement AND justice for her daughter.

"I feel that Kelly really believed in law and order and crime and punishment and I know she would want justice. She was focused on it and in her desire to make being a police officer her career, she always tried to do the right thing," Nancy said.

As to hearing about a new girl friend in Perry's life, Nancy had this to say;
"It's scary to think that this young woman is involved with this man," she said  carefully. "Its a scary thought that even with the facts in front of her, she isn't seeing all the signs and what type of person he really is."

Nancy is quiet for a moment, collecting her thoughts. I can tell that this is difficult for her...
"But she's had a heads up on his character.. Kelly never  got that information.. she never knew what he did before so she never knew what he was really capable of."

Nancy is referring to  family court documents from Chemung County, New York, documenting domestic violence calls that were made to the Elmira police from David Perry's house when he was married to his first wife, Luana. She has since spoken out about his extensive abuse of her AND her kids. Interestingly enough, Perry's children seem to back up his story that he knows nothing of Kelly's  "disappearance," and have either refused to speak to police or have retained an attorney.

Kelly's sister Lauren greeted today's news with some reticence, but also with  cautious optimism and a sense of relief.

"Everybody has been so beautiful; people who don't even know Kelly have been so supportive of our family. We want everyone to know what a blessing that is for us. We have stayed primarily behind the scenes and let the police do their job on Kelly's case. My family and I knew  knew all along that it would come together and today is a huge leap forward towards finding Kelly."

Lauren said that her family believed all along that Perry was involved in Kelly's going missing.

"I called him that Monday, the 14th, after she was reported missing," Lauren said, "and the first thing out of his mouth  was "have you heard from Kelly".... I asked him where Kelly was and he just went off on a tangent, talking about how she "met a  new friend and moved to Utah" , then he said he was in New York, like he'd been there for a while.. it was very strange.He was really rambling.... I finally hung up on him."

Lauren said that her family has been very patient with law enforcement and their efforts to find Kelly ... and a suspect.



Lauren has some thoughts about Perry's actions..

"The moment he took off for Elmira, it raised all kinds of red flags. I hope that his new girlfriend finds out about his true self in time. He is NOT O.J.Simpson; he thinks he will beat this. Every thing he'd doing and saying; running back to Elmira, NOT cooperating with police, running from the Pinellas County detectives when they tried to talk to him... ALL of that bizarre behavior just points to guilt, NOT innocence.

I asked Lauren if she felt that anything was possibly allegedly  premeditated on his part.

"If he DID kill my sister, I don't think it was planned out.. but now that I hear about the gym membership, I am thinking differently. I DO know that with Kelly becoming a cop, she would have naturally been curious about him. Maybe she found out about what he was REALLY like, or she learned something about his character that he found out she knew about. Kelly was going to be a cop and he was a dirt bag. I think there are things that he is involved with that Kelly probably  found out about...things that he would get hurt by if anyone found out. I think that there was a lot of stuff she dug up on him. His personality is such that people don't leave him; he leaves THEM. Maybe that was too much for his pride or his  extreme OCD personality. But that's just my opinion; I'll never know now I guess..." Lauren's voice drifted off.

As we being to finish up our talk, Nancy Rothwell  sighs a big sigh ... she knows that today's news is a positive step, but a baby step in the grand scheme of things. There is enormous hurt yet a quiet dignity in her voice.

'I want people to know that Kelly was a beautiful person who deserves justice; her family and friends would like to see that. We want to thank everyone for their wonderful support. We also want to thank the Pinellas County Sheriff's Office and the detectives that have been working so hard on Kelly's case. We know they won't stop until justice is served for Kelly. Meanwhile, we will take things as the come and be grateful for ANY information that can lead us to Kelly's whereabouts. We're offering a $25,000.00 reward for information leading to where Kelly is. In addition, any money collected on the website, IN ADDITION, from the search fund donations on that site, will ALSO be part of the reward. Please, someone out there knows something and we need your help to bring my beautiful daughter, Kelly Rothwell, home."

Pinellas County Sheriff's Office Homicide detectives have now named
Perry as a suspect in the disappearance of his girlfriend, Kelly Rothwell. Rothwell went missing from 2708 Gulf Boulevard, Indian Rocks Beach FL.


Pinellas County Sheriff's Office Homicide detectives investigating the
disappearance of police cadet Kelly Rothwell have now named her boyfriend,
David Perry, as a suspect. Since Rothwell went missing on Saturday March 12,
2011 detectives have worked to determine how and why she disappeared.

Throughout the investigation detectives have learned from the family and
friends of Rothwell that she would not have gone voluntarily missing. They
told detectives the night she went missing was the same night she was ending
her volatile relationship with Perry and moving out of their Indian Rocks
Beach apartment.

Detectives have long called her boyfriend David Perry a witness in the
investigation, and have repeatedly requested his cooperation. To date Perry
has still failed to acknowledge detectives requests for interviews regarding
that night, and they believe he is intentionally withholding information.
They say he fled to Elmira, New York where he has family, the same night Kelly
was reported missing by friends in Florida. Now those Elmira family members
have stated they will not talk to detectives about Perry and Rothwell, or they
have requested an attorney to be present during questioning.

His bizarre behavior and lack of cooperation coupled with detectives recently
learned Perry began a new relationship with another woman shortly after
Rothwell disappeared, has detectives now naming him a suspect in her
disappearance. Detectives will continue their pursuit of the truth about what
caused Rothwell's disappearance with or without Perry.

Detectives continue to ask for anyone with information about the couple and
specifically David R. Perry to please call Pinellas County Sheriff's Office
Homicide Detectives Michael Bailey and Amy Plourde at 727-582-6200.

Sunday, June 12, 2011 Marked Three Months Since Kelly Rothwell Went "Missing"~~

Sunday night, June 12, 2011 was a day that should have been like any other day for Kelly Rothwell... but instead of having Sunday brunch with friends, or getting ready for another work week on the job as a police woman, friends instead gathered in front of her condo on Indian Rocks Beach to mourn.  They brought candles and orange towels to sit on and reflect about Kelly and her life.... how she touched SO many lives with her kindness, her silly laugh and her gentle nature. Kelly can't be all of those things anymore to the ones who love her, because Kelly  is "missing" and is presumed murdered. She is somewhere out there and one person knows for sure where she is and the circumstances of her demise.

 But he's not talking to police.

But what he IS doing is taunting people on Facebook, spewing derogatory remarks and nasty, vile comments to a family that is grieving for the loss of a loved one... a loved one that HE was supposed to care about... He has been talking to a NEW lady love.. a new "soul mate"... someone who has little idea of his violent, controlling nature. She's been warned but so far hasn't made the connection yet.

But tonight on the beach, friends lit candles and looked out onto the water as the sun set on another day... another day without Kelly's smile, and her sweet laugh~~

The world is a much lonelier place without her in it....

Perry Moves On From One "Soul mate" to Another? and Other Observations

Well friends, it seems that David Perry has a "new" soul mate... 3 months after his OTHER "soul mate" goes missing... things that make you say ..hhhmmmm... Someone he met on Craig's List?? REALLY??
It has been conjectured that the whole time he was giving Kelly such a hard time, following her and alternately begging her to stay with him, he was already lining up his next.."soul mate"...
No one gets THAT close to another person in such a short time.. 2 weeks AFTER Kelly went "missing"???
I don't think so. I think he knew this woman Melissa Walker WELL before Kelly went missing.... so sad that Kelly was SO worried about HIS reaction when she decided to leave him.. she was concerned for HIM.
According to her sisters and close friends, that was just Kelly; sweet, kind and always worried for others.

And one more thing.... I'm sure it would take a GOOD, STRONG NON-INJURED BACK to climb up that mountain in Nevada where the photo of DP and his newest lady-love/soul mate are seen... how do you suppose THAT happened?? It seems that DP is suddenly feeling SO much better...

And new girl/soul mate.. word of advice; if you want to terminate this new relationship, do it by fax.. or text at least...

One of the most disturbing events that happened this week  is that Tom Reilly, Perry's lawyer, actually "friend-ed " the Bring Kelly Rothwell Home page. I don't know about any of you, but I was appalled that he would actually have the temerity to do that. But then again, this is the same person that told everyone to "suck a rock". I can only assume that Mr. Reilly was intent on following the comments made there. His client has been sending threatening emails to people's bosses as well as several people there who frequent the site. May I assume that this was done on Mr. Reilly's advice to his client?
Interestingly enough, Buggers McGee sent in an answer to Mr. Reilly's rock-sucking comment.

Dear Readers: I wish I could repeat the end of a simple phrase, “Boy , are my arms tired”. Moving forward, following the advice of a certain attorney, I give you the top 10 list of things you can/should do after you “suck a rock”:

10: Have your iron level checked . (This reporter got the “all clear, dude” from the P.A.). Apply a lip ointment with at least 15spf, 30spf south of the Mason/ Dixon line.

9. Strongly suggest to your congressman/representative, etc., that Florida should secede from the Union. No, dude, I’m serious. Stop laughing and do it.

8. For God’s sake, hide that whistling sound when in company. ANY company. If the noise doesn’t recede in 48 hours, get some alum/hit up a physician.

7. Do at least 3 sets of 20 of the “fish” exercise. You know, suck in those cheeks. You’ll be talking normal in no time. Although, experience shows, not to be done in front of your mate under any circumstances after an official rock sucking. They will just be disappointed, trust me.

6. Refuse to engage in any game involving the combination of tongue twisters and whiskey for at least 24 hours. My wallet says make it 48 hours.

5. Avoid ANY liquor stores/convenient stores/Title Max. They will see you coming. No, it’s not your pearly whites, darling. Advise you were involved in an experiment as instructed by a NYS attorney to do so. Run hard and do not look back.

4. Purchase a highly toxic, industrial chemical to apply to the rock. After all, you’ve had it in your mouth. (You little minx.) Rinse well.

**3. Throw the rock at the office window. Yes, THAT office window. Don’t worry, you’re equipped with a “spare”.

2. Throw the “spare” rock at the other office window. (No highly toxic, industrial chemical needed. This one is just for effect).

**1. THROW THE ROCK DIRECTLY AT THE HEAD OF THE INFAMOUS CLIENT. YOU KNOW THE CLIENT, HE’S THE ONE GETTING AWAY WITH MURDER. *REPEAT AS NEEDED.

*Independent studies show it’s not necessary to suck the additional rock(s) in order to achieve the goal.

** Hire an attorney and refuse to speak. It is your right.

More Info	A candlelight vigil will be held to honor my sister, Kelly Rothwell. Kelly has been missing since March 12, 2011. This will be a public event and everyone is welcome. Please bring a candle, prayers and an open heart.  The location will be on the side where the gym is on the closet field. There is a set of stairs and a parking lot.
