Court Order Awards David Perry Seized Assets, with Interest


In a Court Order on Tuesday, Judge Joseph Latham awarded David Perry, the only suspect in the disappearance and probable murder of his then girlfriend Police cadet Kelly Rothwell in Florida, the seized assets that law enforcement had taken from him in a raid of his house in March of 2012. Perry has been indicted twice on Felony Grand Larceny charges in for faking an injury in 2003 on the job while working as a corrections officer at the Elmira State Prison Facility in Elmira, New York. The seizure of assets, including money, vehicles and Perry’s Elmira home were part of the Fraud investigation into the Work Comp injury.

 In this newest and inexplicable and baffling move by the NY Court system that has ignored so much evidence clearly in front of them, Judge Joseph Latham, who signed the search warrant for Perry's home in March, has awarded Perry and his attorney John Scanlon the assets seized of Perry's including the $128, 00.00 cash found hidden in Perry's house, interest on that cash amount held by the state, Perry’s vehicles as well as the house itself. This despite outstanding felony Grand Larceny charges brought about by two counties; Broome and Steuben in NY for Work Comp fraud stemming from an alleged 2003 work-related accident that many allege never happened at Elmira Correctional Facility, where Perry was a Corrections Officer at the time. At the time of his arrest in March of this year, Perry failed to disclose the money when asked by the court if he had any additional monetary assets.

Last July, Broome County, Judge Smith allowed Perry to leave  to go to Hawaii to marry Melissa Walker, a woman he met on Craig's List supposedly months AFTER his then girlfriend Kelly Rothwell went "missing " from their shared Florida condo in Indian Rocks Beach, Florida, despite the fact that he is the ONLY suspect in her disappearance and probable murder. 

Additionally, and as an aside, Perry took Melissa Walker’s surname of Walker as his own; changing it and then on his return to New York, getting a New York driver's license in the name of David Walker. Not so coincidentally perhaps is that Perry ALSO obtained an Enhanced Driver’s License or EDL in the name of David Walker in February of 2012, almost exactly 6 months after he married Melissa Walker and took her name. Coincidentally it usually takes 6 months to actually get an EDL and/ or an International driver’s license. According to DMV.ORG, EDLs are only accepted at land and sea border crossings, not for air travel. The license contains radio-frequency micro chipping that uniquely identifies you in CBP databases, (Custom Border Protection,) which should promote a more expeditious cross. EDLs will be approved forms of identification, in full compliance with the new WHTI (Western Hemisphere Travel Initiative) security measures.  Could Melissa Walker have been an avenue by which Perry was able to obtain that license?  Could that be the main reason he married her? In late January/early February, Perry listed his house on the market; the SAME house he used as collateral for bail, AND bought a brand new $25, 00.00 Honda with CASH. Can you say Mexico? I wrote a blog outlining what I thought Perry might do; in it I concluded that he must have been getting ready to take off to Mexico …

In a sworn affidavit, Melissa Walker later told authorities that Perry was getting ready to run off to Mexico. This statement comes from the woman who married Perry just months after he met her on Craig’s List. Walker, a National Guard Reservist, was conveniently stationed in Hawaii, where Perry has always wanted to live, shortly after they met. Perry flew there to marry her earlier this year. When Kelly went missing, Walker was questioned by police as to her possible involvement or knowledge. She denied knowing anything about Kelly’s disappearance and declared that she still loved Perry but would be divorcing him, all the while still keeping in touch with him.
 Yet there is still no divorce decree that says she ever divorced him, despite her numerous protestations to the contrary. Could she be a part of Kelly’s disappearance and the cover up? What did she or does she know about it?

Now another New York judge, Acting Supreme Court Justice Hon. Joseph Latham, has decided that Perry, who had $128,000.00 HIDDEN under a dresser, money, which, by the way that he did NOT declare he had in his possession when asked by the court, is allowed to have it all back because Steuben County DA Brooks Baker didn’t present enough evidence, evidence he HAD in his possession, to convince a judge that Perry obtained the money illegally by faking  a Work Comp- related injury for which he received over $340,000.00 in benefits and pension. Perry also receives Social Security benefits due to the alleged injury as well.

According to the Order, the DA only used two of a potential 16 witnesses’ testimonies; Daniel Kalec, a Corrections Officer, who was in the cell the night that Perry said he hurt his back on an inmate’s bed after a struggle with the inmate, and CO Sgt. Andrew Pedalty, who lives near Perry’s Elmira home. Pedalty saw Perry numerous times riding his bike, running and kayaking, all the while claiming to have hurt his back in the 2003 “inmate altercation”. There are also photos of Perry kite sailing and running in Florida that were provided to the DA, but it is unknown if these were ever presented as evidence. There were several other signed affidavits by other CO’s, those who witnessed the altercation that Perry was never a part of but for some reason, these were not presented as evidence.  CO Craig Mosher is one that was never asked to testify even though he was present and could have refuted Perry’s testimony to Work Comp about the alleged injury that day in October 2003. Why?

During the September 5, 2012 hearing in front of Judge Latham on the seizure of assets matter, Perry remained mute to every question, invoking his 5th Amendment right to refuse to answer so he wouldn’t incriminate himself. Abject of that, DA Baker had no real way to prove anything other than to present what the judge’s order characterized as limited. Investigator Eric Hurd, who has been on this case since the beginning, did not testify either, but provided background information on Kalec’s statement. Why wasn’t he called to testify? Is it possible that DA Baker is holding that both Hurd’s and other witnesses testimonies for the criminal part of this investigation?
One would hope so… but he better do it quick. He is quickly losing any momentum and the time is now to present what he’s got in the way of evidence or Perry will once again get away with about a scratch.

There IS still the issue of the Assault charge that Perry has pending from a fight with James Hargraves, an inmate at the Steuben County jail that Perry put in the hospital with a head laceration; Steuben County is still prosecuting him on that charge. But maybe the judge will just chalk THAT up to good ole’ fashioned hijinks among prisoners and let that slide too…there is absolutely NO telling what these New York judges will do from one day to the next…

Kelly Rothwell, a St. Petersburg Police Academy police cadet, one month from graduation, went missing the evening of Saturday, March 12, 2011 when she left a friend's house to go home to break up with Perry after a stormy three year relationship. Perry has a documented history of domestic and child abuse violence. Kelly, a dependable, steady class attendant at the Academy, had never missed a day of classes. She has not been seen or heard from since.
Perry, who has been described by Rothwell to her family as domineering, controlling, possessive, and abusive, is still the only suspect in her disappearance and probable murder. He took off to New York the same day Rothwell came home to break up with him. Downstairs neighbor Ken Williamson and his wife heard loud thumping on their ceiling, followed by incessant vacuuming. Shortly after that, Perry took off for New York, then left almost immediately after stopping in Elmira and telling his daughter Britney and her husband who were living in his Elmira home ‘not to listen to what people might say about me.” He was tracked to Oklahoma, but from there no one knows where he went. He returned about three days later. More on this in the next blog.

Second Grand Jury Re-Indicts David Perry on Felony Grand Larceny Charges

David Perry, currently in Steuben County Jail on Felony Fraud charges was re-indicted last week by a second Grand Jury on Felony Fraud charges in Broome County stemming from a Work Comp related injury. Those charges were reduced earlier this month after the judge in the case found that the amount of money the State claimed that Perry was awarded was not  high enough to warrant a felony charge. However, Broome County  ADA Sandra Cardone was given 30 days to make her case again and she once again was able to prove the higher charges.

  According to Steuben County Brooks Baker, Perry will be transported  from the Steuben County Jail, where he currently resides, back to Broome County where he will be arraigned on the newer charges. Perry is  charged on separate Felony Fraud charges in Steuben COunty as well as an assault charge on a fellow prisoner. His bail was revoked after police found $128,000 hidden in his home after he had claimed indigence.

 Perry claimed that in October of 2003, he was injured in an altercation with an inmate at the Elmira Correctional Facility where he worked as a Corrections Officer. He claimed to have been part of a group of officers who were set to respond to a "red dot"; a call that there is fight in the prison. But witnesses who were at the fight testified that Perry never touched the inmate, except to escort him to the infirmary well after the fight was over. Prison rules dictate that any CO involved with an inmate altercation should have no further contact with that inmate until the incident is investigated.
Perry claimed disability and retired with a disability pension from the New York State Pension Fund of over $340,000.00,Work Comp benefits and Social Security Disability benefits.

Perry had been know to brag to his fellow CO's that he made over $7000 a month and offered to show several of them a brochure on how to get away with a disability claim.

Perry moved to Indian Rocks Beach Florida after he met Kelly Rothwell at a Sweet Tomatoes restaurant while vacationing in Florida. He moved in with Kelly at her beach condo within weeks.

After an often tumultuous three year relationship, Kelly, who had since then joined the St. Pete Police Academy, went home on Saturday, March 12, 2011 after a weekend with a friend purportedly to break up with Perry, who was controlling, possessive and violent. Downstairs neighbors reported hearing loud banging noises from Kelly's apartment above them, then extensive vacuuming. Perry was known to have Obsessive Compulsive disorder and was a clean fanatic.When sheriffs were called to do a home check on Sunday morning, March 13, 2011, they were hit with a very strong odor of disinfectant and bleach. Kelly was missing and Perry was nowhere to be found. Later that morning Perry answered a phone call from Kelly's sister Lauren with the words "Where is Kelly?"even though word has not yet gotten out about her disappearance. Perry has suddenly left Florida and was on route back to Elmira, N.Y. where he had a house. He has refused to cooperate with police and refuses to answer any questions about his actions on the day that Kelly disappeared.

 Kelly Rothwell was never seen again. David Perry is the only suspect in her disappearance and probable murder. Perry is being held in the Steuben County Jail.

Charges Reduced in David Perry's Broome County Fraud Case

David Perry, the only suspect in the disappearance of Police cadet Kelly Rothwell , of Indian Rocks Beach,FL had fraud charges in New York State reduced to misdemeanor charges on Wednesday after Perry's attorney, John Scanlon convinced the judge that some of the testimony by Perry's co-workers was based on hearsay and not evidence.

Perry was originally charged with Felony Insurance Fraud in Broome County, N.Y. after a  Grand Jury met in February to hear those witnesses testify to charges that Perry, an ex Corrections Officer at the Elmira prison, faked his injuries from an alleged struggle with an inmate. Perry was then able to obtain Workman’s Comp benefits as he was out on disability and not retirement. The charges in Broome County related to those Work Comp benefits he received after his alleged injury, an injury his coworkers maintain did not happen. He is facing similar charges in Steuben County, N.Y. where the State Pension Fund is located. Perry also received his pension at a higher rate because he filed for disability, not retirement. Those charges, as well as a Felony assault charge he is facing from a fight with an inmate at the Steuben County jail, are still pending.

Apparently. the Broome County ADA Sandra Cardone failed to put ALL the witnesses on the stand that actually witnessed the altercation, excluding the Watch Commander, who heard Perry say that he" hoped the fight wasn't over yet", and another, CO who heard Perry say " See ya guys, that's my ticket outta here. I won't be back" when the call, a Red Dot" came over the radio. Only certain CO's, picked at the beginning of the shifts, are to respond to that particular call; they are the ones assigned to monitor and respond  to any altercation.

David Perry was not one of those COs. And it is still unclear why he picked that time to respond; he had to travel from his position in the jail, a long way to where the fight took place.

It makes one wonder if he staged the whole incident as he seemed to know that he would never step foot in Elmira prison again. He claimed his injury was a result of that fight with the inmate, even though several COs who were in the cell and present at the time told the Grand Jury that Perry never actually had contact with the inmate.

So why didn't the ADA use the eyes-on testimony of the people who were there? Perhaps if she had, the  testimony would have been more compelling and Perry would not be skating his way out of Felony charges.One would argue that she could have made for a stronger case. The judges in that part N.Y. seem especially lenient as well; last year Judge Martin Smith, knowing that Perry was a suspect in a probable homicide, allowed Perry to go to Hawaii  for a month, where Perry then married Melissa Walker, taking her last name. Kelly went missing in March and by late July was married to someone he had met on Craig's List.

Meanwhile, Perry sits in the Steuben County jail. It is widely suspected that Perry, who lived in Florida with Kelly Rothwell, killed her on March 12, 2011 when she went home to break up with him. He is a suspect in her case but has yet to be charged by the Pinellas County Sheriff's Department. And no one knows why...

 It's been almost 17 months since Kelly Rothwell's disappearance.

Meanwhile, Kelly Rothwell is STILL MISSING....

David Perry’s Broome County Bond Revoked at Bail Hearing Today

David Perry, the only suspect in the disappearance and probable murder of his then-girlfriend St. Petersburg Police Cadet KellyRothwell appeared in a bail hearing before Judge Martin Smith in Broome County,New York court this morning.

Perry, transported from the Steuben County Jail where he is currently being held on almost identical Fraud and Larceny charges as Broome County, appeared with his attorney John Scanlon in the Broome County courtroom.Perry is charged in Broome County on charges of Felony Grand Larceny and Insurance Fraud related to a Workman’s Comp claim of injury while he was a Corrections Officer at the Elmira Correctional Facility in Elmira, New York. He is charged in Steuben County because the New York State Pension Fund deposited his Pension fund checks at a bank there.

The charges stem from Broome County because Perry has been collecting Work Comp benefits, which are paid out by the New York State Insurance Fund, where the NY State Insurance fund is located. He was arrested on those charges last June, made bond and was living in his house at 1708 West Church Street in Elmira.

The State of New York re-arrested Perry on Felony Grand Larceny and Fraud charges related to the Pension Fund on March 13, 2012, a year and a day after Kelly Rothwell went missing in Florida after she tried to break up with him.

Last month, Perry was arrested again, in the Steuben County jail, for a jail fight that sent an inmate to the hospital with serious head injuries. Perry was charged with Felony Assault and is awaiting trial for that charge as well.

Citing that assault charge as proof of Perry’s violation of his bail stipulations, Judge Smith formally revoked Perry’s Broome County bail. Perry was transported back to Steuben where he waits for his trial for the Pension Fund and Felony Assault charges. After that trial ends, said the judge, Perry will be transported back to Broome County where he will sit in jail until those charges are answered to as well.

Judge Smith told the court that a trial is scheduled for the next 90 days. It was unclear if he was talking about the Broome County or the Steuben cases.
This is the same Judge Martin Smith who allowed Perry to travel to Hawaii last year to visit his now-wife Melissa Walker. They are still married.

Either way, David Perry will NOT be going anywhere anytime soon.

Meanwhile, Kelly Rothwell will be missing one year and two months tomorrow. It’s time to bring her home and her killer to justice.

Perry's House Surrounded by State Police



Perry’s House Surrounded by State Police, Search Warrant Issued to Search the House.

As I write this, Perry’s house is surrounded by 5 marked State police cars, 4 unmarked State Police cars (one with K9) and officers have been in the house for a few hours. Meanwhile Perry is hoping to leave Steuben County jail for a quiet life at home.
Good luck with that… Broome County will next exercise THEIR warrant for his revoked bond…
It’s not clear what the police are searching for but possibly it could be for a passport or some hidden extra papers. But not so fast Dave...

It seems that once again, like a slithering snake in a veritable jungle, David Perry has managed to get his bail reduced during a Motions hearing for a CIVIL matter in which NO bail application was sent before the judge. His bond in Steuben is now $25,000.00 personal and $50,000.00 for the house. What the hell is happening in Mayberry, Opie?

Today’s appearance was to discuss the terms of Perry’s forfeiture of assets, a CIVIL matter which should NOT have contained any bail discussion, which is criminal. I guess, in the interest of expediency, lack of understanding of the jurisprudence process, sheer boredom, whatever, Perry’s attorney was able to introduce an “Oh by the way, Judge, while you’re here, can we talk bail for my perfectly RESPECTABLE client, etc..”
Unfortunately, DA Brooks Baker is out of town and didn’t attend the hearing. Had he been there, I’m SURE that he would been able to impart the wisdom of letting someone of Perry’s caliber back out on the street.

What did ya hide in the house Dave? A body, perhaps? Another suitcase full of cash and a passport? Divorce papers??

David Perry to Face Judge Monday on Motions Related to His Assets Forfeiture


David Perry, who is being held at the Steuben County Jail on felony grand larceny charges, will face a judge Monday morning as the judge will hear motions on the forfeiture of assets imposed upon him almost two weeks ago. Perry's house has a $200,000.00 lien on it, his bank accounts have been frozen and his vehicles confiscated. His daughter Britney,with whom Perry was living, is also under scrutiny for her possible involvement in the hiding of Perry's other monetary assets.

Perry, who remains the only suspect in the case of missing and presumed murdered Police cadet Kelly Rothwell in Indian Rocks Beach Florida, will stand with his public defender Jason Vichinsky in court. But bail won't come up. At least it shouldn't.....

“This is not a bail hearing,” said DA Brooks Baker’s confidential secretary on Friday. “This part ONLY relates to the civil matter of the forfeiture of assets, not the criminal matter of the grand larceny charges. As of today (Friday) there had been no bail application sent to the court and there is nothing on the court’s calendar,” she said.

Apparently, an application for bail must be sent to the judge which puts a notice to the judge that Vichinsky would want a bail hearing for Perry in order to negotiate a lower bail. Perry is currently being held on $100,000.00 bond, because DA Baker feels that Perry is a definite flight risk.

Perry had bought a brand new Honda with almost $25,000 in cash, was able to obtain an international drivers license with the name David Walker and had a contract with a buyer for his house in Elmira, NY. That home was the collateral Perry used to post bond in Broome County on the FIRST set of felony grand larceny charges, stemming from the NY State Insurance Fund, who paid Perry his Work Comp benefits on an alleged injury. Walker is the last name of his wife Melissa Walker who has still not divorced Perry. Perry married her in August in Hawaii and obtained a Hawaii drivers license at that time with the last name Walker.

Friday afternoon, I learned from a confidential source that the bail on Perry from Broome County had been revoked. Perry will no longer be able to use his home as collateral and will now be on the hook for the full $25,000.00 bond.

According to a source, it actually makes more sense for Perry to remain in jail, as he would get no credit for time served if released to Broome County’s jail.

Currently, if there any Broome County court proceedings that Perry must attend, Broome County must go to Steuben County and transport him there and back.

But time is not on David Perry’s side. With his OCD, one wonders how long he can stand the filth. I wonder did anybody bring him any birthday cake today on a jail tin...

Strange to have someone so evil have a birthday on the Lord’s Day, don’t ya think?

David Perry to Remain in Steuben County Jail, Charges Stick!

David Perry was arraigned this afternoon in Steuben County NY on Grand Larceny charges stemming from allegations that he collected Work Comp and Pension benefits from a fraudulent injury in October 2003.
A secret Grand Jury met in February to hear several witnesses testify to charges that Perry, an ex Corrections Officer at the Elmira prison, faked his injuries from an alleged struggle with an inmate. Perry was then able to obtain Workman’s Comp benefits as well as a larger portion of his pension, as he was out on disability and not retirement. It is the NY State Pension Fund, located in Steuben County that charged him in this matter. He is also facing almost identical charges in Broome County, where the NY State Insurance Fund is located.

Perry was arrested last Tuesday afternoon and arraigned before a judge. However, Perry stopped the proceedings, refused the offer of a Public Defender and instead said he would hire his own attorney. Today’s hearing was the first available on Judge Latham’s docket. Consequently, Perry has spent 8 days in jail.


How Perry would have been able to pay for an attorney remains a mystery. He was served with forfeiture of asset papers, which means that his bank accounts were to be frozen, the deed to his house held (and the pending sales contact negated), with a $200,000 lien bond placed on the property and his other assets, including a brand new car and a motorcycle were to be confiscated.

Apparently frozen assets put a serious crimp in Perry's spending habits;Perry was assigned Public Defender Jason Vichinsky. He has pleaded NOT GUILTY to the Grand Larceny charges and will remain in jail until April 9th when a bail hearing will be set. I mean, even a blind man can see he's guilty....

David Perry to Face Judge Latham, District Attorney Brooks Baker at 2 PM Wednesday in Steuben County, N.Y.

David Perry rolls the dice again today at 2 PM when he faces Judge Joseph Latham of Steuben County to answer a second set of charges of Grand larceny. Initially given a bail of $100,000 cash and a $200,000 bond on his property, Perry appeared at his arraignment last Tuesday after his arrest by New York State troopers and assisted by the West Elmira PD at his home in Elmira, NY. But he stopped the proceedings and insisted on hiring an attorney before the arraignment was finished. So Perry has sat in jail for over a week, waiting for his day in court.

This SHOULD be getting to feel like “old hat” for Perry, as this is his second arrest for Felony Grand Larceny charges; the first time was in June of last year, when he was arrested in Broome County on the same set of charges. Then Perry used his home on West Church Street in Elmira as collateral for the bail bond. Now it has come to light that he was also served with asset forfeiture papers; his assets are supposed to be frozen and his car, home and motorcycle seized. One wonders how he could possible even get out of jail, even if his present bond is reduced; since the home he lived in was seized as an asset, shouldn’t that make his first bail revocable, as it was used to secure his bond? And if he got out tomorrow, would Broome County take another shot at him and put him back in THEIR jail?

Perry was trying to sell his house; indeed there was a rumor that a contract was imminent. Now there is a big bond on the home and his shiny new car, bought with cash, as well as his motorcycle, should all become part of those assets being frozen, as well as his bank accounts in several counties.

So where will Perry GET the money to buy a lawyer for his arraignment tomorrow? Rumors were swirling that his (ex) wife Melissa Walker was to have been back in his life and that she might be the one to bail him out. Certainly she has denied this in posts to this blog. Indeed, I received one this afternoon; it was in response to someone asked for her to give an antique diamond ring back to the Rothwell family. Here is what she said:


“Dave did not give that ring to me, nor did I ever see such a ring or any other for that matter. Of course I would have returned it to her family. I would have gone to detective Bailey If I had received it. I would have gone to detective Bailey had Dave behaved suspiciously or given me any information about this case. This is something I can promise you. Dave would know this because he knows the type of person I am.
Thank you all for your encouraging words and prayers. I will not return to Dave.
I have a couple words about my sister. She has been going through a lot lately. I think her health matters may be contributing to her actions. My sister and I are not the concern here. This is about Kelly. She is in my thoughts and prayers. Her family and friends are in my prayers.”

One wonders what can be going on … will she show up in court tomorrow? Does he have stacks of money hidden somewhere that he can use to bail himself out? Anyone who helps him will become suspect, I believe, as authorities would want to know the origin of any money used for bail.

One can only hope that David Perry will continue to sit in a dirty, dank jail cell AFTER tomorrow‘s proceedings.

Melissa Walker Answers Her Family, Critics Today

Melissa Walker, the Army Specialist working in Hawaii and who married David Perry, wrote a response to my blog post today. In my post, I was incredulous that, according to her sister Cassie Williams, Melissa was going BACK to David Perry, possibly bail him out of jail and then ‘maybe go on the run with him.’ I expressed my shock and dismay that such an intelligent woman would do something so stupid; to stick by a man who in all probability murdered Kelly Rothwell, defrauded the government of thousands of dollars, severely abused his ex wife and their children and could possibly be mixed up in other nefarious enterprises, based on his constant traveling from Florida to New York and then back again.

Today I received this response from Melissa Walker: QUOTE:

I have heard so many angry words toward me. Any harsh words toward me are not any worse than what I tell myself. Although I have made many pathetic, idiotic choices I have not hurt anyone and would never intend to. Those who are in my life know this and would never question it. With the exception of my older sister, my family and friends are helping me through this. Thank you so much to my loved ones who stand by me through good and bad choices. I will not comment on my older sister. She has to live with herself same as I do. I am haunted by my poor decisions. Since Dave was put back in jail it has given me time away from his words that continuously feed into my insecurities. It is no excuse. I am upset, very regretful, sad, angry, humiliated, and extremely sorry to say the least. Because I realize my weakness in this situation I have changed my number and will do what it takes to keep him out of my life entirely. I thank those of you who are not bashing me. Those who do, it does add to my pain. Despite all of this I will stand back up, because that is what I do. I am so sorry for Kelly (RIP). I will continue to pray for her family and friends as I have done from the beginning. Another thing, none of the above speculations are true. None! Melissa Walker END QUOTE

It seems as if Melissa and her sister Cassie are not seeing eye to eye as to what Melissa’s real intentions are towards David Perry. It seems pretty clear by the above statement that Melissa will NOT be bailing Perry out. But it also seems pretty obvious to me that Melissa Walker would not have written to me if she didn’t believe what she was writing. And it is also abundantly clear that women who meet up with men of Perry’s diabolical intellect DO find it extremely difficult to extricate themselves from these types of relationships.

But I want to answer one critic who said I was blaming Melissa for what I called her incredible stupidity. Melissa was WARNED about David Perry, as one of my viewers commented… the other women were NOT. And I am not blaming Melissa for anything OTHER than not heeding those warnings. I did question whether she knows more than she’s telling about what happened to Kelly. I wouldn’t be a responsible journalist if I didn’t look at EVERYONE connected with this case. I mean EVERYONE.

And I will continue to investigate until Kelly Rothwell is home in Baltimore, Maryland with her family.

After the last blog, I received what I perceived to be a threat from Cassie Williams :

Cassie I am not "thrilling" myself “by writing denigrating things about your family. According to your own words you said you couldn't stop your sister from making this grave mistake. How can you really direct your anger at me for what your sister is doing? I acknowledged that you tried to
help your sister. Please don't wish ill on me because of her irresponsible actions. Instead perhaps your family should focus more on why Melissa continues to head down an obvious path of destruction. I feel bad for your family; I reached out to you to help you and her. Instead you told me
half-truths. Please do not blame me for your family's pain. Leigh

Say It Ain’t So….It’s a “What the Hell?” and an “I Can NOT Believe It” Moment…..

Despite an over whelming amount of firsthand knowledge, obvious evidence of fraud, deceit and abuse and a HUGE dose of stupidity, it seems that Melissa Walker has decided to stand by her man after all...well, CLOSE to her man at this point as he is in jail at the present… or at the very LEAST make kissy noises through the recorded jail phone system…

When there are some things that make absolutely NO sense and one wonders what the HELL is going on in a woman’s mind, along comes David Perry, womanizer, manipulator, obsessive abuser, thief, probable killer and Vacuum King to totally turn the world on its ear; to literally charm the pants and possible mind of Melissa Walker, Army Specialist, Craig’s List Hottie, wifely bail poster long enough to post his bail on the second set of fraud charges he is now facing. Can Melissa ignore the mounting evidence of his involvement in Kelly Rothwell’s probable death?

Apparently she can, she does, she will... Etc… sounds a bit like marriage vows, doesn’t it?

It seems to me that this incredulous move on Ms. Walker’s part, to re-align herself with Perry suddenly seems incredibly suspect. What does she REALY know? Was she already involved with Perry while he was still with Kelly? She denies it but one has to wonder the curious coincidence of David Perry’s comments to the gym manager that he was moving to Hawaii and cancel his member ship. Then Melissa, a Las Vegas Army National Guard Reservist gets transferred to Hawaii… Kelly Rothwell goes missing, David Perry marries Melissa Walker, and then she “realizes the truth about how dangerous he is”... Files for divorce on New Year’s Eve, the deadline for joint tax deductions and all OTHER kinds of stuff like that (no joined assets, how convenient).

Seems like a good way for Perry to hide some money, wouldn’t ya say?

Now she is suddenly back with him, standing firmly by his jail cell, prepared to fork over the ten grand needed to spring him from the pokie. WHAT???? Two other words come to mind but I can’t say them here.

All of her protests of not knowing anything now ring hollow to my ears… maybe the divorce was a ploy to take the heat off of her? Shift the attention elsewhere? How else to you explain it?One interesting fact is that despite the protest of never reading anything written about this whole debacle at Perry’s request, my IP capture on my blog speaks volumes of OH HELL NO, THAT’S A LIE….

Melissa Walker said in an email that she only recently (read December) looked at this blog and what was written herein… that she was moved to realize that he was bad, naughty, not so nice.. blah blah blah…. Not so, not so…

I have documented proof of MANY blog views from Las Vegas, Hawaii and California(where Melissa’s family lives) from as early as late May of last year and then MANY more after that and continuing to the present from Hawaii and then Louisiana where Cassie, Melissa’s sister lives. Now I can respect the fact that Cassie wanted to protect her sister and it’s admirable that she tried to talk some sense into her. I got nothing but love for that...But don’t lie and tell me that she NEVER looked at the many posts from myself and other journalists just “because he told me not to”.. Kinda crap until DECEMBER??? Again, WHAT??? You add the other two words...

But something smells rotten in Denmark... yeah; something does NOT make sense… Could Perry’s diabolical, evil mind (yeah, I said it) have thought THAT far ahead to find a girl on Craig’s List who was going to move to Hawaii, murder his girlfriend, marry the Craig’s List girl by convincing a lenient judge (Yay, way to go Judge Smith, what a Patriot!) going to Hawaii while out on bail for Fraud and Grand Larceny charges, change his name on his license to HERS, possibly put a LOT of stolen money into new wife’s bank account, then realize that his assets might be seized and says they should divorce so that the money will stay in HER name (Stop me if you’re having trouble following along) and then when they DO seize the assets (they did today, but that’s tomorrow’s blog) and THEN get the girl to use said stolen, hidden money to bail him out from the (wait for it..) Charges of stolen money???

I can’t MAKE this stuff up!!!! OMG!

I felt sorry for Melissa Walker initially... Now I’m not sure she isn’t all part of this elaborate scheme and has been from the beginning… an old girlfriend in the way is a powerful incentive to do bad things, especially when she knows your dirty little secret and where the suitcases of cash are hidden…

That’s all for tonight... my indignation needs some sleep.

An Intimate Interview With Lindsay Rothwell



Lindsay Rothwell will be appearing on Nancy Grace on March 14 to talk about her sister Kelly’s life and the impact that her death has had on her family and friends.

In a phone interview tonight Lindsay spoke about when Kelly was living in Florida at the condo that she and David Perry had shared. Kelly had been offered a fabulous job in Charleston, West Virginia with Embassy Suites and went there for three months, living at the hotel for free while she tried the job on for size. It was during that time that Kelly and David argued very often; Kelly really wanted to accept the job in West Virginia on a permanent basis. She had fallen in love with Charleston and was only 6 hours away from her family in Nottingham, Maryland.

But Perry didn’t like West Virginia; Lindsay says that by that time in their relationship, Kelly had decided to leave Perry. According to Lindsay, Kelly at some point broke off the relationship.That’s why she chose the job in West Virginia.But Perry was persistent in his pursuit of Kelly, who was still living in West Virginia and was adamant that Kelly NOT move permanently and also insisted that she keep the condo in Indian Rocks Beach. During that time in a conversation with Lindsay, Kelly told Lindsay that “Perry was involved in something bad “and she was trying to get out of the relationship altogether.She also told Lindsay that Perry was making frequent drives every couple of weeks from Florida to New York, and vice-versa, sometimes stopping in West Virginia to plead for Kelly to take him back.

“He made promises to her, trying to manipulate her, telling her he would stop whatever he was doing that was "bad", Lindsay said. Kelly told her that what he was doing could have potentially devastating consequences for her if anyone found out.

“Kelly told me, in so many words, that Perry threatened her; that she would pay for it if she said anything anybody. We were in a restaurant at the hotel she worked at and I could tell by her body language and the look in her eyes that she was scared, afraid of him and what he could do to her. But I believe that in her heart, she NEVER thought he would have killed her, but she did believe that he could really hurt her physically and drag her into his potential nightmare, involving her in something she did not want to be in."

Lindsay said that David’s manipulation extended to keeping Kelly from her family.
“When they would drive back and forth to New York before Kelly tried out the job with Embassy Suites, Perry would refuse to stop to visit Kelly’s family, even though they literally drove by the exit right near the Rothwell home.

“He wouldn’t even let her have five minutes with us... that must have just really hurt her that she was so close to her family yet he would just drive by the exit,” Lindsay says angrily.

”They drove by here a lot on their trips to New York and only one time did he let her stop and see her family. They were supposed to stay for four days but all of the sudden Perry had an “emergency” in New York and insisted that instead of staying at the Rothwell’s, Kelly had to go with him to a hotel. He wouldn’t even let my sister stay at my Mom’s house; instead he insisted she had to go with him back when he went back to New York first thing in the morning. Kelly asked him to just go, take care of whatever emergency he said he and pick her up on the way back. He wouldn’t let her stay. I think he thought she was going to run to get away from him. He would not have had control of her; he was a control freak. He knew she would have had the support of her family. That’s why it was so sad when she gave me that hug.”

It was then Lindsay says that it seemed that Kelly sensed that it might be the last time she would see her family.

“I could tell from her touch and body language and the way she looked at me. Her eyes were sad, scared. When she hugged me goodbye, it was an extra long, genuine hug; she held on really tight to me. It was like I might not see you again, and I love you. And it was like she was saying ‘I’m sorry for this evil man who is putting me through this’, like she couldn’t find another way out of it. It was like she knew that it was the last time we would ever see her. I felt it. I could feel that something was wrong, something wasn’t right. I was scared but didn’t know why. Looking back, now I know why I felt that.”

Lindsay Rothwell never saw her sister Kelly again.

Kelly moved back from West Virginia, giving up her job, a job that she called her dream job.

It was shortly thereafter that Kelly joined the Police Academy. Lindsay believes that Kelly joined to protect herself from Perry. She also wanted to help other women who were in the situation that she was in. She knew it was bad. He had threatened her and although she denied it when Lindsay asked her if Perry had ever hit her, Lindsay saw the truth in her eyes.

“She denied it, acting like everything was ok,” Lindsay said sadly.

Kelly’s focus at the Academy was centered on battered women and drug intervention, two things that Lindsay believes Kelly was going through personally with Perry.
“I knew from previous conversations with Kelly that that’s why she chose to focus on these two main areas of law enforcement.”

Lindsay believes that Perry killed Kelly because she knew too much about his involvement in something.She feels that Kelly was targeted by Perry when he first met her, looking for someone who had a place in Florida. She feels that he used Kelly and her Florida connection. That’s why he made her put everything in his name, to keep control over her. He kept her away from her family. That’s why he didn’t want her to move to West Virginia,why he insisted on keeping the condo.Lindsay thinks his back and forth trips were suspect.

“He chose Kelly for a reason; I don’t think it was love at first sight. I think he used her to get what he needed, to keep a connection in Florida. He flattered her and showered her with all kinds of gifts, until she found out his true side, his evil side. He told her everything he thought a beautiful woman would like to hear. He preyed on her need to feel loved;he manipulated her,like I’m sure he’s done to other women in the past.”

David Perry took Kelly Rothwell’s heart and then he took her life…

David Perry Arrested!!!!

David Perry, the only suspect in the case of missing Police Cadet Kelly Rothwell was arrested earlier today on Grand Larceny charges stemming from The New York State Pension Fund in Steuben County, NY. The charges stem from money that was paid to Perry as part of his retirement package from the New York Correctional Facility in Elmira. Because Perry was allegedly injured in an inmate altercation in October of 2003,he received a greater part of his pension than he would have been if he had just retired after his 25 years...
According to sources close to the case, NY State police and West Elmira troopers surrounded Perry's house and he surrendered without incident.
The charges are listed as a CLASS C felony according to law enforcement. Perry was arraigned in Steuben County and is currently being held in the Steuben County Jail on $100,000.00 cash or $200,000 property bond. Perry's 1708 West Church Street house is valued at approximately $78,000.00. Perry used that property for his FIRST bail, from charges of Grand Larceny and Fraud stemming from the New York State Insurance Fund in Broome County, which paid Perry Workman's Comp benefits. He cannot use that property as bail collateral again.
Perry was attempting to sell the property and it was listed with an agent.
Below are the explanations of a Class C Felony, as defined by NY State Law:

Class C felonies include:
• burglary in the 2nd degree
• grand larceny in the 2nd degree
• forgery in the 1st degree
• criminal possession of a forged instrument in the 1st degree
• promoting prostitution in the 1st degree
• manslaughter in the 2nd degree
• arson in the 2nd degree
• robbery in the 2nd degree
• criminally possessing narcotics in the 1st and 2nd degrees
BAIL
Typically 10 percent fee is paid to bail bondsman who, in turn, pledges money to the court and agrees to be responsible for the debt. In the case of accused of federal offenses, the fee may be as high as 15 percent. A commercial bail bondsman, who is in the business of posting bond for a fee. The accused, the accused's family and/or friends will pay the bondsman's fee. No money is refunded. The initial payment is a fee to the bail bondsman. Bondsman may hire bounty hunter to locate the accused and bring him to court. The bondsman can sue the accused to recover any money that may have been forfeited to the court.

A Year Later and Little to Go On; A Family is Still in Pain and Kelly Rothwell is Still Missing…






Surrounded by photographs of missing Police Cadet Kelly Rothwell to his left and David Perry, the only suspect in her disappearance to his right, Pinellas County Sheriff Bob Gualtieri spoke at a press conference this morning to update the case.

“Today marks the one year anniversary of Kelly Rothwell’s disappearance from her Indian Rocks Beach condo she shared with then boyfriend David Perry,” Sheriff Gualtieri said. “I’m here to announce that an additional $25,000.00 reward is being offered by the Pinellas County Sheriff’s department for information that leads us to where Kelly Rothwell is.”

Sheriff Gualtieri explained that this reward, made possible using money seized in drug busts, will be in addition to the $25,000.00 already being offered by the Rothwell family, for a total of $50,000.00. Sadly conceding that Kelly is in all likelihood deceased, Gualtieri nonetheless hopes that the public might have seen something then or sees something now, might remember something last March 12, 2011 that might provide a clue as to what happened to Kelly Rothwell.

“As of right now, we have few leads and we’re hoping the public will see these photos (on easels behind him) and remember something.”
Gualtieri also said he was not hopeful that Perry would give any information about Kelly, even if confronted with jail time for the New York fraud and larceny charges Perry currently faces.
"Why would he admit to an even stronger charge, like murder?"

Admitting that this was a very difficult case to work, Gualtieri said that the information they do have has been very limited. Pinellas County Homicide detectives Mike Bailey and Amy Plourde have been assigned to the case since last year: Plourde has a special tie to Kelly, in that she also attended and graduated from the St. Petersburg Police Academy, where Kelly was to have graduated from last April.
Gualtieri acknowledged to reporters that forensics from the condo search yielded little to go on conceding that since they lived together, it would be normal to find both of their DNA mingled together.

Gualtieri also said that New York State investigators sent portions of the rug in David Perry’s 2006 Honda Civic, to Pinellas County Sheriff’s Office for forensic testing of the fibers. The Pinellas County Sheriff’s Forensic Unit is widely respected throughout the US as being one of the top investigative forensic labs in the country. They did not find any female DNA or fibers on the rug, but the Sheriff admitted that the rug had been thoroughly cleaned by Perry, using very strong chemicals, prior to his releasing the car to New York detectives.
“Strong corrosive chemicals, like those in cleaning products, break down DNA very quickly,” he explained.

Last March 12, 2011, Kelly went home after lunch with a friend, with the intention of breaking up with Perry, whom she described as controlling and manipulative. At 3:30 PM, Kelly left the Chili’s Restaurant on Rt. 19 where she was having lunch with her friend Donna Scharrett in Clearwater to drive back to Indian Rocks Beach. Donna had asked Kelly if she wanted her to come with her, to help her with her belongings. Kelly declined; telling Scharrett that it “would be ok” and that she was more worried about Perry’s reaction to her leaving him, thinking he might be sad.

“Kelly was more concerned about how it would affect Dave and she wanted to be able to comfort him, in case he got upset,” Scharrett told me in an interview last March. “That’s the kind of girl Kelly was, always concerned for other people.”

Kelly walked alone into her second floor condo at approximately 4:15 PM and was never seen again.

Downstairs neighbors recall hearing a series of bangs or thuds around 4:30 PM that afternoon, then the sound of incessant vacuuming from Kelly’s apartment above theirs.
That same afternoon/evening, David Perry abruptly left Florida, bound for Elmira, New York, his hometown. Cell phone pings from his cell phone around the area of I75 and State Road 52 were later investigated by the PCSO (Pinellas County Sheriff's Office) and a search was conducted in that area. Kelly was not found. There was also a cell phone ping from Kelly’s phone around 5:20 which coincided with a text that Scharett received, purportedly from Kelly. But the strange wording and misspellings made Scharrett suspicious; they did not sound like Kelly at all. Then Kelly did not show up to retrieve keys for a house she planned to rent from a fellow cadet later on that Saturday March 12, 2011. When Donna Scharrett heard that she failed to show up, she called Pinellas County Sheriff’s Office the next morning, March 13, with a sick fear of dread in her heart. She asked them to do a home welfare check on Kelly, knowing that it wasn’t like Kelly to miss the meeting that evening of the 12th to pick up keys, especially when she had planned to move into the house after leaving Perry later that afternoon.

Pinellas County Sheriff Bob Gualtieri told reporters today that Kelly is presumed deceased and that Perry, who was officially named a suspect in her disappearance last June, has not cooperated with police inquiries. He was also suspected of traveling to both Ohio and Oklahoma during the immediate weeks after he fled to New York.

“He won’t talk, he knows how law enforcement works, and he used to be a Corrections Officer in New York. He has counsel and he isn’t saying a word. We can’t get him to cooperate at all.”

Meanwhile, David Perry became involved with a woman named Melissa Walker, a National Guard Reservist, who Perry met on Craig’s List. Whether or not he started an online relationship while he and Kelly were still together is not yet known. But too many coincidences keep popping up. Perry told the manager of the local gym where he worked out, that he was moving to Hawaii soon and to cancel his membership. Then shortly thereafter, Melissa Walker, who was living in Las Vegas, was re-stationed at Tripler Army Hospital, in Hawaii.

With Perry returned to New York, charges were filed against him by the New York State Insurance Fund, who paid his Workman’s Comp claim from October 2003, in which he claimed to have been injured in an inmate-related altercation. Several of his fellow Corrections Officers stepped forward to testify at a Broome County Grand Jury that Perry faked his injury and then bragged about how much money he was making from Work Comp and Social Security. Perry was arrested in May on his way back from where police think was a visit to Melissa Walker in Las Vegas. Meanwhile Perry was seen , both in Florida and New York, working out, biking and kite sailing in the Gulf of Mexico behind the condo he and Kelly has shared.

Although indicted on Felony Grand Larceny and Fraud charges, Perry used his home in Elmira to post bail after spending five days in jail. Remarkably, with a judge’s permission, Perry was allowed to go to Hawaii last August to visit Melissa Walker.

He married her in a waterfront ceremony on the beach.

Perry remains in Elmira, taunting Kelly’ s supporters on FaceBook and a salacious blog, True Crime Report, where he spews venomous vitriol about Kelly, her family and those who seek justice for her probable death. He conveys a “catch me if you can” attitude towards those that would bring him to justice, stirring up false controversy among Kelly’s many followers and then reveling in the attention.

For a whole year, Kelly’s mother Nancy, her sisters Lauren, Lindsay and Kristen, her father and countless friends and family have been waiting for some news, some clue as to where Kelly is. It’s widely believed that David Perry killed Kelly Rothwell and disposed of her body.

The Rothwell family did not attend the press conference, preferring instead to mourn their devastating loss in a much more personal and private setting. But they are grateful for the love and support that they have been shown since Kelly‘s disappearance and probable homicide. Her mother Nancy lights a candle every night at a memorial they have constructed in her home outside of Baltimore Maryland, where family photos and pieces of Kelly’s history surround her with memories that sustain her. Kelly’s dog Lucy is also now with Nancy and is a constant comfort and a blessing to her, she says. Nancy cannot fathom how anyone would hurt Kelly or why… her pain is palpable,even through the phone.

Kelly’s sisters Lauren and Lindsay, fraternal twins, have also tried to make the incredibly difficult adjustment to life without their big sister. They both say that they know she is around them, that she is free of pain. But it will always be hard to reconcile that Kelly is no longer a phone call or an email away.

Nancy Rothwell,in a phone interview this afternoon, said the Rothwell family is overwhelmingly grateful to the PCSO for the doubling of the reward being offered in the effort to find her daughter Kelly.

“Today is such a painful day for me and my family as we reflect back on Kelly’s life. She was always energetic, kind to everyone, and always tried to trust and find the best in everyone,”she said, emotion welling up in her soft voice.

Sadly, for Kelly Rothwell, her trust in David Perry was horribly misplaced.
And it cost her her life.

One year, 12 months, 52 weeks, 365 days, 8,765.81277 hours, 525,948.766 minutes … Kelly Rothwell has been gone. Someone knows something, someone saw something….

Meanwhile Kelly Rothwell is still missing…..

A Part of Kelly Rothwell’s Heart Came Home Last Month


A piece of Kelly found its way home to her family last month as one of Kelly’s dogs, owned when she was married and living in Colorado, came home to the Rothwells to stay. Lucy was one of two Golden Retrievers that Kelly’s ex husband Doug Sanders and Kelly had had when they lived in Norwood Colorado on 40 + acres. Lucy was always Kelly’s dog.

“Clarence, the other Golden was always Doug’s dog,” Kat Jayroe, Kelly’s best friend since 1996 said. “They used to joke all the time that the dogs picked them individually. Lucy was two years younger than Clarence and was always so sweet… just like Kelly…”

Kat’s voice trembles a bit at the memory.The loss of her best friend has hit her very hard. She and Kelly were virtually inseparable friends; they met in 1996 in college at Adams State in Alamosa, Colorado.They went everywhere together.

“We were always affectionate and hugging each other all the time,” Kat laughed. “People use to tease us, but we were just very close; we spent a lot of time together. We both were into spiritual healing and Reike and we both loved crystals. We had a wonderful connection with one another..."

Kelly was studying geology at Adams State and in 1997 she met Doug Sanders in one of their classes. According to Kat, Kelly and Doug were like two peas in a pod.

“They hit it off right away,” she said. “They were a lot alike, both kind of reserved; they didn’t share a lot of emotions with a lot of people, but they were crazy for each other.”

So when Doug told Kat he had a friend named Jason Jayroe she should meet, Kat did and soon the four of them went everywhere together.

In June, 2004, Kelly Rothwell and Doug Sanders were married. Kat Jayroe was Maid of Honor in Kelly’s wedding. Jason was Doug’s Best Man. When Kat and Jason got married, the roles were reversed; Kelly was Maid of Honor in Kat’s wedding and Doug was Jason’s Best Man.


The four friends stayed close and lived near each other until Kat and Jason moved from Telluride to Fort Collins, about 6 hours away. But they called each other often. Meanwhile, Doug, Kelly, Clarence and Lucy all settled down as a family; Doug was a ski instructor in Telluride, Kelly in Human Resources for The Peaks Resort. Lucy and Clarence grew fat and happy.

In September of 2007, Kelly’s company sent her on a business conference to Florida. When she came back, Kat said she was changed.
“Kelly told me how great Florida was, but more than that… She said she had met an amazing person, someone who really understood her, noticed everything about her… she told me she had met her soul mate.”

No one knew at the time that that person was David Perry, who later would become the only suspect in Kelly's disappearance last March 12th.

In June of 2007, Kelly made the decision to leave Colorado and move to Florida. She packed up everything that she wanted into her green Subaru and drove to Florida.

“I’ll never understand why she did that,(move to Florida) but I guess her relationship with Doug, in her eyes, had run its course.”

She left Lucy and Clarence with Doug.

“I think Kelly knew that the dogs would be better off with Doug; they were used to the wide open spaces to run in and she had no idea what type of condo or apartment she might be living in. But I know it hurt her to leave them. She and Lucy always had a special bond. She knew in her heart that Lucy would be better where she was.”

Doug Sanders rented his house out and spent that summer in Australia as a ski instructor there. Friends watched the dogs for the summer. When he came back from Australia, he opted to keep renting his house out, opting instead for a smaller apartment that was much closer to his job. But with that consolidation came space issues; Clarence and Lucy were both big dogs and Doug didn’t have enough room for both of them.

“About two months ago, Doug asked Jason and I if we could take Clarence. He was originally going to just keep Lucy. Then Jason got the idea that maybe the Rothwell’s would like to have Lucy. She was such a part of Kelly’s life and both of us thought it was a great idea. Nancy (Kelly’s mom) had already met both dogs when they came out to Colorado for Kelly’s wedding. So Nancy knew what a great dog she was. Jason called Nancy; she said she would be happy to take Lucy. So between Doug, Jason and Nancy, they got all the necessary preparations done for shipping her East.”

Jason bought a large dog crate and Kat worked with Lucy for a few days helping her get used to it.

“Lucy is just such a great dog; she is so mellow and well-behaved. I just love her!” Once again, emotion takes hold and Kat sits quietly for a moment before speaking again.

“We kept Lucy for a few days to help her get her acclimated to the large cumbersome dog crate. Jason and Nancy Rothwell coordinated the flights from Colorado to Maryland, where the Rothwell’s live. We talked with both Lauren and Nancy about; they were excited about having Lucy. They said it was like a piece of Kelly was returned to them.”

But giving Lucy up was the hardest part for Kat. Lucy represents to her all that Kelly was; vibrant, strong, alive, beautiful. Lucy was Kat’s last real connection to Kelly; to give that up was very difficult. Kat said goodbye to Lucy at the house, then sat in the front yard and cried for her friend.

“The last thing Kelly said to us when she left for Florida was, “Please take care of things and watch out for Doug. Make sure they’re all ok.. That’s how Kelly was, always thinking of others. I never saw her again…”

So as one door closes on this story, another now opens.

After a long 7 hour plane ride and a few delays, Lucy arrived safe and sound in Maryland and is now in the care of Nancy Rothwell, Kelly’s mother. According to Nancy, she is adapting well and sleeps beside the bed, just within an arms gentle reach of her. Nancy feels blessed to have her.

“She is such a sweet heart,” Nancy gushes. “She is so good and well mannered. I have to tell you, it really does feel like we’re getting a part to Kelly back too. And she just LOVES Lauren!! I’m very thankful to Doug and Jason for putting this all together! We all are so grateful… I really do feel like a piece of Kelly came back to me. When I hug Lucy, I remember that Kelly too, is present. It gives me great comfort just knowing she is here with our family.”

Lucy is now at home, among the things and people that helped shape Kelly Rothwell. Lucy is much loved.

“Lucy will always remind me to keep moving, go forward and persevere,” Nancy Rothwell said with a hint of sadness. “She is a part of Kelly that I could get back…... It’s what I can hold onto.”

Its been a year and still there is no word on where Kelly is or what happened to her.

Meanwhile Kelly Rothwell is still missing…..

Will David Perry be Able to Afford Valentine's Gifts and Which Lucky Gal Gets the Romantic VD Dinner at Wegmans?

No one has seen David Perry lately. And nobody has seen him tooling around town in his swanky his little blue 2006 Honda lately. License plate number # BRC -5978. The same Honda he drove to New York last year, leaving the same night his girlfriend Kelly Rothwell went “missing.” The same blue Honda he refused to give up to New York authorities for almost two weeks. The same blue Honda he probably cleaned out so meticulously, clinically removing any traces of… what? Camping equipment? A large sail bag? Kelly’s body perhaps?
What with his intense OCD raging, it’s a wonder Perry even let the cops touch his little blue Honda at all. Sound familiar folks? Perry has a penchant for replacing things and people that are no longer useful to him. He smoothly glides from one object or person to another with such fluidity; it’s hard to keep up with him these days.
Look how he forgot Kelly? After a three year relationship, how could it have been so easy to hook up with someone else SO fast? And then MARRY someone, all the while the “love of his life” is missing? He never bothered to help look for Kelly, never spoke to law enforcement about her... AT ALL….Like I said, replacements always seems to be in the wings. Now he is being replaced; divorced by a woman who probably saved her own life by doing just that.
Perry has some deep insecurities, according to his ex-wife Luana that might explain his narcissistic behavior. “Dave can never be alone,” she said in an interview. “He always has to have someone around him. When we were married, he was seeing two, sometimes three other women. Once he brought a girl home to OUR home. He told me to just deal with it! He went after a good friend of mine at a party; she was married at the time. But he didn’t care about that. He took advantage of her when we were all partying and then just left her on the floor. He didn’t care. He has no conscience, no morals. He doesn’t care who it is, if they’re married or even much younger than him. He has to prove that he’s bigger and badder than everybody else. He’s so sick... it was a nightmare living with him. I’ll bet he had someone even while he was married to Melissa Walker. There’s no way he could be alone for that long with her so far away.”
So how IS David Perry paying for all of his new toys? We know that he is being investigated for fraud by the New York State Insurance Fund for claiming an injury in an inmate-related scuffle he allegedly was involved in. We also know that Social Security, which he is also collecting, is hot on his trail for fraud as well. So where is the money coming from? Luana has a few ideas…
“Dave always had a lot of money on him and he used to keep a big stash in the house. He always seemed to know guys who were known drug dealers at the time too. When we were still married, we used to drive down to Florida all the time from New York and then back up to New York. I never asked what he was taking and bringing, but I had a pretty good idea...”
Luana said that Perry smoked a lot of pot; in fact on one of the domestic abuse calls to the house while they were still married, the investigating officer found pot growing in the basement of Perry’s house and a gun on top of the refrigerator. One anonymous New York officer still can’t figure out to this day how he got away with that; the charges were suddenly dropped at arraignment.
Does Perry have a secret stash that he’s been living on? How can he afford trips to Hawaii for almost a month, an engagement ring (‘Oh, and I want that back’) and a beach wedding as well as a new apt while his house ,which is up for sale, is being shown. How is he affording the first, last and deposit? Since he has been accused of defrauding the state of New York, do you think they just MIGHT want to cut him off?? And if they have, then how is he paying for his new toys?
Perry has some Florida Keys connections too; friends with fast boats and fishing charters. Great business, with wonderful, easy access to the Gulf of Mexico from say, Islamorada. Does anyone else here go HHHMMM? Anybody?
Does anybody really believe that Perry came BACK to Florida last year for BAR STOOLS??? So what WAS in the storage unit that he had to have?
So many questions that have no answers…
Like, where is Kelly Rothwell, Dave? Did you drive her to New York in the blue Honda and dispose of her up there? UP there where you thought no one would look? Is that why you were SO cocky in your comments to this blog, claiming that no one would ever find her? Guess again... No one has given up the search; if anything, people are more determined than ever to bring Kelly justice.
Oh and enjoy Valentine’s Day, Dave….Don’t forget to wear red for all your gals…

It’s almost a year that Kelly has been gone… 11 months today
Where is the justice that Kelly and her family deserve? Time will tell...

David Perry Already Has a New Girlfriend… and a New Apartment.

It seems that David Perry already has a new girlfriend… he admitted as much on a blog called True Crime Report. Of course, he made the mistake of saying “I already have a new gf” first in his prose about his latest conquest, before he caught himself and changed it to “He already has a new gf”. But you get the gist. He tried to backtrack but it’s out there now. I’m sure that, while this knowledge may hurt Melissa’s heart, I hope she realizes it’s better to find out now, rather than later. I hope she can heal from all of this. He has also moved out of his house; I think he’s been out of there since he put it on the market. He as much admitted this as well, saying his “suck a rock attorney already knows” when one of the commenters asked him about his new apartment. Is it in Burdett, Vestal, or Endicott? Does he have to be near his bail bondsman in order to meet the requirements for his bail? Is he already living with the new girl, even as he begs his soon-to-be –ex-wife to come back to him? Thank God Melissa Walker has a level head on her shoulders now, a strong family presence to back her up and lives thousands of miles away from him. I wonder if his bail bondsman even knows that the house he used as collateral for his bond is up for sale. Is that even legal? I’m assuming the DA in his case knows all this. I guess we’ll just have to wait and see. Meanwhile, the wheels of justice for Kelly Rothwell continue to turn. Because she is still missing….. David Perry Texts to Melissa Walker’s Sister Show Creepy Pattern of Obsession, Stalker-Like Behavior.

With the news this evening of possible felony aggravated stalking charges being levied at David Perry in the disappearance of Kelly Rothwell, David Perry’s character (or lack of it) is coming under increased scrutiny and certainly lends credence to the stories of his stalking that other women, including his ex-wife Luana, co-workers and ex girlfriend Ann Morris have told about him.
Perry’s pattern seems to remain a constant; with all of the women he has either dated or been married to, as with Kelly, he started out charming and attentive, gradually gaining the confidence and trust of the object of his affections. But soon he graduated to subtle forms of control; as in Kelly’s case and the others, he put the cell phones in his name. Then, as in Kelly’s case, gradually the bank accounts become joint accounts and are in his hometown Elmira, N.Y. Bank of Chemung Canal. Soon he started to call, “just to hear your voice”, then he texted when the woman doesn’t answer right away. He sent flowers and presents to the woman’s work, which he did in Kelly’s case as well as other women he was involved with. He started showing up unannounced and became resentful when he wasn’t welcome. He became threatening when the woman tried to leave him. Those that did get away became objects of his anger and revenge and possibly with Kelly, the ultimate betrayal, he killed her instead of letting her walk away from him.
All of this behavior is classic stalking; a man obsessed with perfection and control, who manipulates at first by kindness and generosity, but degenerates into fear, violence and ultimately, murder. David Perry exhibited all of the classic signs of a stalker, not only with Kelly, but the many other women he was involved with over the years.
His latest “victim”, Melissa Walker, married the kind, generous guy that Perry always is in the beginning, although he was beginning to show signs of obsession and control already into their four month of marriage. The cell phones were already in his name and as Melissa was slowly starting to realize that something wasn’t quite right, her family became increasingly suspicious and fearful for her.
Older sister Cassie is very close to Melissa and she began to suspect that something was just off in the relationship. She and her family were not even told until after the wedding that Walker and Perry had married.
“I even mentioned that she should wait until he was found innocent of the charges,” Cassie said. “Then she could marry him with a clear conscience and they wouldn’t have all that hanging over their heads. But she loved him so much and he was so wonderful to her, she just wanted to be a wife and eventually have a family.”
But even as Cassie suspicions grew, Perry convinced Melissa not to read what was being written about him and not to believe anything being said about his involvement in Kelly Rothwell’s disappearance. So she didn’t.
“You have to understand,” Cassie said, “that my sister is smart, beautiful and loves people. She wants to see the good in everyone. So she ignored whatever signs there were that something wasn’t quite right and just went with her heart.”
Just like Kelly Rothwell…..
On December 27th, when a family member called Cassie in tears and told her to read a letter that I had written to Melissa on this blog, Cassie knew that what was being said about Perry had merit. She convinced Melissa to read it. On December 30th, Melissa filed for divorce. And true to form, David Perry started barraging her with texts and phone calls. When he couldn’t get through to Melissa, he started texting Cassie, trying to get her on his side. His texts were rambling and full of misspellings. But more than that, they show the mind of a man on the edge that seems poised to start stalking his latest victim. Below are the texts sent to Cassie over an afternoon/evening period. Note that he calls Melissa his “yummy wife” and makes reference to their souls being together forever. CREEPY and possibly dangerous?
If it sounds familiar, it’s because it’s the same thing he said to Kelly. And Luana… And Ann… And Wendy… He recently told a person in New York that Kelly was his “soul-mate”. He insisted he had nothing to do with her disappearance.
Below are the texts he sent, complete with misspellings and punctuation. Interesting to note is the spelling of “ happymess”, a noted misspelling that appeared in David Perry’s “Innocent” FaceBook page often as well as the spew that was written on True Crime Report, with vile and disgusting comments that many attribute directly to Perry.

I am assuming that Perry is referring to his daughter Brittani’s new baby, Grace, who it is said he has not been allowed to see.
What is most frightening to me is that Melissa may think that she will be able to just divorce this man and walk away. I hope that she is not that naïve. I hope she has strong defenses and people around her that will hold her up and keep her safe.

Two other points of note:
1) Melissa wants her name back. She has told Perry that she does NOT want him to have her last name. He took her last name when they married. Did he think a name change would suddenly make him pure in everyone’s eyes? Does he have another motive, say; to get out of town unnoticed if everything goes south?
2) David Perry replied to her divorce lawyer that he will only sign the divorce papers IF Melissa gives him his ring back. Sound familiar? Guess he thinks he will need it for his next conquest…. REGIFTING again Perry? Really?

Meanwhile, Kelly Rothwell is still missing…
Ten months today… and her family is still waiting for answers~~
